Following are bills being tracked on behalf of DRSD as of today. You’ll note any pending hearings noted in RED as a means of alerting you to those scheduled activities. Other actions are noted in BLACK. Highlighted indicates the bill is most likely done for this session. One exception would be ‘tabled’ bills that might be taken off the table.

Senate Bills

SB 9 - revise the definition of a designated caregiver.

Seeks to revise the definition of a designated caregiver in relation to medical cannabis; yet “designated caregiver” is widely used in other areas. The proposed change removed “a person” and replaces it with “an individual” which appears to be a legal term. Signed by Governor on 2/15/22

SB 53 - make an appropriation to increase workforce housing and to declare an emergency.

Seeks to make an appropriation to increase workforce housing and to declare an emergency. It is seeking an appropriation of $150,000,000 of general funds and $50,000,000 in federal fund expenditure authority to the Governor’s Office of Economic Development for purposes of increasing housing supply across South Dakota. Scheduled for hearing with Senate Committee on Appropriations at 8:00AM on 2/16/22 – Room 362

SB 55 - appropriate funds for the expansion of broadband infrastructure and to declare an emergency.

Seeks to make an appropriation of $50,000,000 in federal fund expenditure authority to the Governor’s Office of Economic Development to be used for grants for the continued expansion of broadband in the state of South Dakota. Scheduled for hearing with Senate Committee on Appropriations at 8:00AM on 2/17/22 – Room 362

SB 59 - revise property tax levies for school districts and to revise the state aid to general and special education formulas.

Seeks to revise property tax levies for school districts and to revise the state aid to general and special education formulas. It is proposing to reduce the maximum tax levy on agricultural property and on owner-occupied single-family dwelling. It proposes an increase in the overhead rate. It proposes a reduction in the maximum special levy that may be assessed. It proposes adjustments to allocations for students with disabilities. Referred to Joint Appropriations Committee Passed – Yeas 6, Nays 0 on 1/18/22

SB 65 - delineate uses for the South Dakota housing opportunity fund.

Seeks to revise how the South Dakota housing opportunity fund may be used to serve low-to-moderate income households in securing affordable housing. Referred to House Committee on Appropriations on 2/15/22

SB 69 - provide for an electronic system to update voter registration information.

Seeks to allow persons currently registered to vote with voter information contained within the master registration file to submit identified changes to their voter registration form electronically. Referred to House State Affairs on 1/25/22

SB82 – Seeks to revise the admissibility of certain statements made by persons with developmental disabilities concerning certain crimes i.e., any act of sexual contact or rape or describing any act of physical abuse or neglect… Tabled Passed Yeas 7, Nays 0 on 1/25/22

SB89 – Seeks to require insurers to provide coverage for hearing aids and related services to persons under age nineteen. Scheduled for hearing with Senate Committee on Appropriations at 8:00AM on 2/17/22 – Room 362

SB159 – Seeks to exempt any person suffering from a severe mental illness from capital punishment. Do Pass Amended Passed – Yeas 6, Nays 1 on 2/15/22

SB174Seeks to make an appropriation to provide a grant for the construction of a facility to provide certain health facilities – up to $16,000,000 from the general fund to assist in the construction of a facility that will provide all of the following: specialty rehabilitation pediatric hospital, specialty school for children under twenty-one, intermediate health care facility for children under twenty-one, and outpatient rehabilitation pediatric services. Scheduled for hearing with Senate Committee on Appropriations at 8:00AM on 2/17/22 – Room 362

SB185Seeks to revise certain provisions regarding voter registration records. Scheduled for hearing with Senate State Affairs at 10:00AM on 2/16/22 – Room 414

SB186 – Seeks to expand Medicaid eligibility by the Legislature. Do Pass Failed – Yeas 12, Nays 23 by Full Senate

House Bills

HB 1001 - revise the freeze on assessments for dwellings of disabled and senior citizens.

Seeks to revise the freeze on assessments of dwellings of disabled and senior citizens. Proposes adjustments to person’s income levels, includes the indexing annually of household income, and adjusts the true market value at which it does not apply to a single-family dwelling unless an exception is met. Referred to Senate Taxation on 2/9/22

HB 1011 - revise the application process for the reduction of tax on dwellings owned by paraplegics.

Lies out the process needing to be completed, by whom and when, if an individual wants to seek this reduction in taxes. Delivered to Governor on 2/8/22

HB 1014 - make an appropriation to fund tax refunds for elderly persons and persons with a disability and to declare an emergency. 

This is an annual bill which seeks an appropriation to fund tax refunds for elderly persons and persons with disabilities. It is seeking an appropriation of $450,000 for the Department of Revenue, for the purposes of providing refunds of real property tax and sales tax to elderly and disabled persons. House Deferred to Another Day Passed on 2/15/22

HB 1016 - make an appropriation for costs related to disasters in the state and to declare an emergency.

Seeks an appropriation of $2,946,882 for costs related to disasters in the state. It would go to the special emergency and disaster special revenue fund. Do Pass Passed – Yeas 7, Nays 0 on 2/10/22

HB 1019 - make an appropriation for the payment of extraordinary litigation expenses and to declare an emergency.

Seeks an appropriation of $1,500,000 for payment of extraordinary litigation expenses and would go to the extraordinary litigation fund. Scheduled for hearing with Joint Committee on Appropriations at 8:00AM on 2/16/22 – Room 362

HB 1029 - revise the definition of telehealth for purposes of health insurance policies.

Seeks to revise the definition of telehealth for purposes of health insurance policies. Proposes that “Telehealth” the use of secure electronic information, imaging, and communication technologies by a health care professional to deliver health care services to a patient. Deferred to the 41st Legislative Day Passed – Yeas 10, Nays 3 on 1/19/22

HB 1040 - reduce the maximum property tax levies for the general fund of school districts.

Another bill seeking to reduce the maximum tax levies for the general fund of school districts. Tabled Passed – Yeas 15, Nays 0 on 1/19/22

HB 1041 - facilitate legislative oversight of settlement agreements involving a state entity or official.

Seeks to have legislative oversight as part of any settlement agreements involving a state entity or official. Referred to Senate State Affairs on 1/25/22

HB 1055 - require informational transparency regarding the issuance of executive orders.

Seeks to require informational transparency regarding the issuance of executive orders by adding involvement of the Executive Board of the Legislative Research Council and opportunity for members of the public to provide testimony at a hearing and to submit written comments for inclusion in the record. Deferred to the 41st Legislative Day Passed – Yeas 9, Nays 3 on 1/31/22

HB1068 – Seeks to clarify processing of sexual assault kits performed on individuals ages sixteen and seventeen. House Failed to concur, appoint Conference Committee Passed – Yeas 65, Nays 3 on 2/3/22; Senate Conference Committee appointments on 2/4/22

HB1086 – Seeks to provide for the redistribution of donated prescription drugs and medical supplies, setting out definitions, parameters for the donation, acceptance and dispensing of donated prescription drugs and medical supplies, and others aspects of implementing such a program. Referred to Senate Health and Human Services on 2/8/22

HB1104 – Seeks to allow the board of county commissioners in every county may provide suitable and sufficient courtroom facilities to conduct business at a place other than the county seat. Delivered to Governor on 2/7/22

HB1105 – Seeks to allow for a good cause exception to the time for an involuntary commitment hearing. Delivered to Governor on 2/7/22

HB1129 Seeks to prohibit forms of discrimination to access to organ transplantation. Referred to Senate Health and Human Services on 2/8/22

HB1282 – Seeks to allow inpatient psychiatric facility placement alternatives for certain patients. Do Pass Passed – Yeas 13, Nays 0; Place on Consent Passed on 2/15/22

HB1284 – Seeks to increase household income thresholds for a paraplegic tax reduction. Do Pass Passed – Yeas 67, Nays 0 by Full House on 2/15/22

HB1287 – Seeks to revise certain provisions regarding the crime of rape and provide a penalty therefor. Scheduled for hearing with Hose Judiciary at 10:00AM on 2/16/22 – Room 413

HB1334 – Seeks to make an appropriation of American Rescue Plan Act moneys for certain home and community based services… $80,000,000 in federal fund expenditure authority to Department of Human Services and $13,600,000 in federal fund expenditure authority to Department of Social Services… Deferred to Another Day Passed by Full House on 2/14/22
