Legislative Session Update

Since the last days for individuals and committees to introduce bills have passed, the total number of bills for the current session is 339 for the House and 212 for the Senate for a total of 551. Crossover Day – the last day when bills and joint resolutions must pass out of the house of origin is February 23rd. DRSD's bill tracking list can be seen below.
Additionally, we have included a list of cracker barrel sessions that are being held in communities throughout South Dakota. Check them out below!

Following are bills being tracked on behalf of DRSD as of today. You’ll note any pending hearings noted in RED as a means of alerting you to those scheduled activities. Other actions are noted in BLACK.
Senate Bills
SB 9 - revise the definition of a designated caregiver.
Seeks to revise the definition of a designated caregiver in relation to medical cannabis; yet “designated caregiver” is widely used in other areas. The proposed change removed “a person” and replaces it with “an individual” which appears to be a legal term. Do Pass Passed – Yeas 13, Nays 0; Place on Consent Passed on 2/3/22
SB 53 - make an appropriation to increase workforce housing and to declare an emergency.
Seeks to make an appropriation to increase workforce housing and to declare an emergency. It is seeking an appropriation of $150,000,000 of general funds and $50,000,000 in federal fund expenditure authority to the Governor’s Office of Economic Development for purposes of increasing housing supply across South Dakota. SB 55 - appropriate funds for the expansion of broadband infrastructure and to declare an emergency.
Seeks to make an appropriation of $50,000,000 in federal fund expenditure authority to the Governor’s Office of Economic Development to be used for grants for the continued expansion of broadband in the state of South Dakota.
SB 59 - revise property tax levies for school districts and to revise the state aid to general and special education formulas.
Seeks to revise property tax levies for school districts and to revise the state aid to general and special education formulas. It is proposing to reduce the maximum tax levy on agricultural property and on owner-occupied single-family dwelling. It proposes an increase in the overhead rate. It proposes a reduction in the maximum special levy that may be assessed. It proposes adjustments to allocations for students with disabilities. SB 65 - delineate uses for the South Dakota housing opportunity fund.
Seeks to revise how the South Dakota housing opportunity fund may be used to serve low-to-moderate income households in securing affordable housing. Hearing scheduled for 2/8/22 at 10:00AM with Senate Commerce and Energy – Room 412
SB 69 - provide for an electronic system to update voter registration information.
Seeks to allow persons currently registered to vote with voter information contained within the master registration file to submit identified changes to their voter registration form electronically. Do Pass Passed Yeas 20, Nays 15 – Full Senate
SB82 – Seeks to revise the admissibility of certain statements made by persons with developmental disabilities concerning certain crimes i.e., any act of sexual contact or rape or describing any act of physical abuse or neglect… Tabled Passed Yeas 7, Nays 0 on 1/25/22
SB89 – Seeks to require insurers to provide coverage for hearing aids and related services to persons under age nineteen
SB159 – Seeks to exempt any person suffering from a severe mental illness from capital punishment.
SB174 – Seeks to make an appropriation to provide a grant for the construction of a facility to provide certain health facilities – up to $16,000,000 from the general fund to assist in the construction of a facility that will provide all of the following: specialty rehabilitation pediatric hospital, specialty school for children under twenty-one, intermediate health care facility for children under twenty-one, and outpatient rehabilitation pediatric services.
SB185 – Seeks to revise certain provisions regarding voter registration records
SB186 – Seeks to expand Medicaid eligibility by the Legislature
House Bills
HB 1001 - revise the freeze on assessments for dwellings of disabled and senior citizens.
Seeks to revise the freeze on assessments of dwellings of disabled and senior citizens. Proposes adjustments to person’s income levels, includes the indexing annually of household income, and adjusts the true market value at which it does not apply to a single-family dwelling unless an exception is met. Fiscal Note Requested by House
HB 1011 - revise the application process for the reduction of tax on dwellings owned by paraplegics.

HB 1014 - make an appropriation to fund tax refunds for elderly persons and persons with a disability and to declare an emergency.
This is an annual bill which seeks an appropriation to fund tax refunds for elderly persons and persons with disabilities. It is seeking an appropriation of $450,000 for the Department of Revenue, for the purposes of providing refunds of real property tax and sales tax to elderly and disabled persons.
HB 1016 - make an appropriation for costs related to disasters in the state and to declare an emergency.
Seeks an appropriation of $2,946,882 for costs related to disasters in the state. It would go to the special emergency and disaster special revenue fund.
HB 1019 - make an appropriation for the payment of extraordinary litigation expenses and to declare an emergency.
Seeks an appropriation of $1,500,000 for payment of extraordinary litigation expenses and would go to the extraordinary litigation fund.
HB 1029 - revise the definition of telehealth for purposes of health insurance policies.
Seeks to revise the definition of telehealth for purposes of health insurance policies. Proposes that “Telehealth” the use of secure electronic information, imaging, and communication technologies by a health care professional to deliver health care services to a patient. HB 1040 - reduce the maximum property tax levies for the general fund of school districts.

HB 1055 - require informational transparency regarding the issuance of executive orders.
Seeks to require informational transparency regarding the issuance of executive orders by adding involvement of the Executive Board of the Legislative Research Council and opportunity for members of the public to provide testimony at a hearing and to submit written comments for inclusion in the record.
